« Thiendella FALL et les membres de la commission de réception des candidatures doivent être poursuivis et emprisonnés pour fraude électorale »
C’est un fait politique inédit dans l’histoire du Sénégal : après l’irrecevabilité absolue de la liste de la coalition BENNO BOK YAKAAR, pour dépassement du seuil maximum de parrains autorisé par le Code Electoral (55 328 parrains au lieu de 55 327), la majorité présidentielle vient littéralement de s’effondrer avec la preuve apportée du non-respect de la parité de sa liste nationale (au niveau des suppléants, 2 femmes se succèdent : Rokhaya N’DAO (43 éme place) et Maimouna N’DIAYE (44 éme place).
L’article L.149 de la Loi n°2021‐35 du 23 juillet 2021, portant code électoral dispose :
« Pour pouvoir valablement présenter une liste de candidat, les partis politiques légalement constitués, les coalitions de partis politiques légalement constitués et les entités regroupant des personnes indépendantes doivent recueillir la signature de 0,5 % au minimum et 0,8 % au maximum des électeurs inscrits du fichier général…. En tout état de cause, la parité homme-femme s’applique à toutes les listes. Les listes de candidatures, titulaires, comme suppléants, doivent être alternativement composées de personnes des deux sexes ». Toute liste de candidature, titulaires, comme suppléants, doit être alternativement composée de personnes des deux sexes, sous peine d’irrecevabilité. Il n’existe pas 1 liste composée de titulaires et 1 autre liste composée de suppléants ; mais une seule liste composée de titulaires et de suppléants. Si la parité n’est pas respectée, que ce soit au niveau des titulaires ou de celle des suppléants, de facto, la liste est irrecevable.
La question que se pose tous les sénégalais est la suivante : comment se fait-il que la liste de la coalition Benno Bok Yakaar qui ne respecte ni la règle du seuil maximum fixé par le parrainage (55 327 parrains), ni celle de la parité a pu être déclarée recevable par la commission de réception des candidatures ? La réponse est simple : Thiendella FALL, et certains membres de la commission de réception des candidatures, de connivence avec le ministre de l’intérieur Antoine DIOM, n’ont procédé à aucune vérification de forme ou de fond de la liste de BENNO, et se sont contentés de déclarer ladite liste recevable, sans appliquer une seule fois, les dispositions prévues par le code électoral, en matière de contrôle des parrainages et d’étude de la recevabilité juridique du dossier de BENNO.
Ce qui s’est passé à la DGE avec la liste de la coalition BENNO BOK YAKAAT est une fraude d’une extrême gravité qui porte les germes d’un coup d’état électoral, une infraction pénale et un manquement grave aux principes de transparence, et de sincérité qui fondent l’essence d’une élection démocratique. Dans cette affaire qui porte atteinte à l’image et à la crédibilité du Sénégal, la responsabilité du Directeur Général des Elections, Thiendella Fall est engagée : il doit être poursuivi, arrêté et emprisonné. Tous les membres de la commission de réception des candidatures qui ont participé à la validation de la liste de BENNO BOK YAKAAR (recevabilité), doivent être identifiés et poursuivis.
Une enquête approfondie doit être menée pour situer le degré de responsabilité du ministre de l’intérieur Antoine DIOM et son niveau d’implication, dans cette fraude électorale réalisée en amont, qui a conduit à la recevabilité d’une liste irrecevable.
La liste de la coalition BENNO est frappée d’une double irrecevabilité (dépassement de
1 parrains et non-respect du de la parité) qui ne peut faire l’objet d’aucune régularisation. Cette irrecevabilité est absolue, et définitive.
Macky SALL a créé un Monstre (le parrainage) qui lui échappe et dont il ne maitrise ni les tenants, ni les aboutissants. Depuis 2012, à chaque scrutin, Macky SALL a toujours voulu terrasser l’opposition par KO, de manière totalement déloyale (élimination de candidats ou de listes).
Cette fois, la manœuvre s’est retournée contre son auteur : la majorité présidentielle est sonnée, totalement KO : Il n’existe aucune possibilité juridique pour que BENNO puisse participer aux élections législatives du 31 juillet 2022.
C’est un énorme séisme politique à l’échelle de RICHTER, dont Macky SALL ne sortira pas indemne (adieu le rêve d’une 3éme candidature !).

Nota bene : Attention, la situation de la liste de YEWWI est totalement différente de celle de BENNO
Lorsque le mandataire de la coalition YEWWI accompagné d’un huissier s’est présenté dans les locaux de la Direction générale des élections, le 11 mai 2022, pour notifier à la commission de réception des candidatures, le retrait de candidature de 2 membres figurant dans sa liste départementale à Dakar, l’étude de la recevabilité des listes de candidature n’avait pas encore débuté (nous étions encore à la phase de contrôle et de régularisation des parrainages). A cette étape du processus, le Code électoral de 2021 autorise le mandataire de YEWWI à faire une déclaration complémentaire de candidature pour remplacer 2 membres de la coalition, qui ont retiré leur candidature (démission).
Le constat d’huissier établi le 11 mai 2022, prouve que le mandataire de la coalition YEWWI a respecté la loi et les délais, afin de faire procéder au remplacement de membres de la coalition qui ont retiré leur candidature.
Tel n’est pas le cas de la coalition BENNO BOK YAKAAR, qui n’a effectué aucune démarche de retrait de membres de sa coalition, jusqu’au moment où l’étude de la recevabilité des listes de candidature a débuté (BENNO a franchi illégalement le stade du contrôle des parrainages suite à une fraude et une complicité de la DGE).
Séisme politique aux Législatives : la liste de la coalition BENNO est doublement irrecevable !
