La démocratie est « l’affaire du Peuple », disait Lincoln (président des États-Unis, 1860-1865), « c’est le gouvernement du Peuple, par le Peuple et pour le Peuple), aurait-il ajouté. Les lois et tout ce qui en résulte (normes administratives secondaires, arrêtés, circulaires etc.) sont le produit d’un consensus sociétal dont l’objet ultime est d’assurer la stabilité, la paix, sans lesquelles l’épanouissement collectif du peuple n’est point possible. Si l’application stricte de la loi devait déboucher sur l’avènement d’une situation qui a le propre de produire les effets inverses et donc « pervers » (instabilité sociale, violence, anomie et remise en cause de l’esprit dans lequel on construit le modèle), s’arrêter alors à la lettre ne serait faire point preuve d’ingéniosité mais une façon d’assumer volontairement la bêtise humaine. Voilà qui explique pourquoi le baron de la Brède et de Montesquieu, Charles de Secondat intitula son œuvre fondamentale de droit public : « De l’Esprit des Lois ». Aurait-il pensé déjà, bien avant nous autres, que le fait que le texte de loi puisse s’appliquer strictement en toutes circonstances et indépendamment des considérations de légitimité, serait tout aussi pernicieux pour la démocratie que l’absence de règles? Voilà pourquoi il n’a pas donné à son œuvre le titre : « Du texte », mais celui-ci « De l’Esprit des lois ». Une leçon que j’ai bien apprise et assimilée il y a 30 ans déjà dans les locaux qui portent le nom d’un des illustres fondateurs du droit public (l’Université Montesquieu Bordeaux IV).
Que se passe-t-il dans les faits? Que devrait faire le Conseil constitutionnel pour nous sortir de « l’ornière » et nous préserver ainsi, par voie de conséquence, de la « cassure » irrémédiable de la « vitrine » démocratique sénégalaise?
Les faits :
Les deux plus grandes forces politiques du pays (la coalition au pouvoir, BBY et celle de l’opposition, YAW) courent toutes les deux le risque d’une forclusion totale d’une part et partielle de l’autre, aux prochaines élections législatives si l’on acceptait « bêtement » de s’arrêter à une interprétation stricte de la loi.
Pour les uns, le surplus de parrainages serait une cause d’invalidation de leurs listes sur l’étendue du territoire; pour les autres, il est question de non-respect de la parité dans la capitale qui serait la cause légale d’un rejet. Si l’on s’arrête à une stricte interprétation de la loi électorale, aucune de ces deux listes ne serait donc validée, et les deux coalitions les plus importantes du pays ne participeraient pas aux prochaines élections législatives (à l’échelle nationale pour l’une, à l’échelle départementale, la capitale Dakar, pour l’autre). Si un tel raisonnement devait prévaloir, le texte l’emporterait sur l’esprit, la légalité prendrait le dessus sur la légitimité. Or, donc, il est bien possible d’emprunter une voie de raisonnement dans le processus d’interprétation juridique sans pour autant vicier la loi ni dans sa forme, ni dans le fond. Je ne parle même pas de jurisprudence qui ne peut et ne doit être ni fixe, ni figée, ni définitive, le raisonnement à la base d’une décision de justice, quelle qu’elle soit, peut et doit évoluer au gré des circonstances et de l’appréciation actualisée des situations et autres conjonctures, en libre interprétation d’une science qui est justement et essentiellement interprétative (le droit). Sinon, d’ailleurs, on serait en situation de valider le sens contraire
du dicton popularisé, « seuls les imbéciles ne changent pas ».
Des solutions :
Comment le Conseil Constitutionnel peut-il raisonner en privilégiant l’esprit sans vicier la forme et sans préjudice du fond ?

Ce que je nomme le « délit d’illégitimité de fait » ne serait-il pas acté par la formation d’une assemblée élective dans laquelle ne figurerait aucun représentant choisi par les militants ou autres sympathisants du parti au pouvoir et d’une partie de l’opposition (la capitale, Dakar) la plus significative en termes de poids électoral (données empiriques appréciables à partir des résultats des dernières élections)? Si oui, que peut faire le Conseil constitutionnel pour éviter une telle situation d’iniquité de fait inédite, sans violer les lois et surtout l’esprit qui sous-tend leur avènement pour ne point se rendre complice d’une illégitimité de fait produite par l’étroitesse d’une interprétation de textes de loi?
Qui plus est, dans une démocratie de consensus et de compromis comme la nôtre, il est arrivé dans le passé et encore récemment que la loi sur la parité par exemple n’ait pas été respectée. Vous souvenez-vous que le sieur Moustapha Diakhaté, alors président du Groupe parlementaire de la coalition au pouvoir avait suggéré l’invalidation de la liste de Touba pour non-respect de la loi sur la parité? L’esprit démocratique sénégalais se décline ainsi : pour régler un conflit politique, on fait appel à l’autorité maraboutique, pourquoi ne devrait-on pas alors par conséquent lui accorder des privilèges, sorte d’« arcana imperii » qui dérogent à la règle stricte de droit, parce que justement, ce ne sont pas des citoyens comme les autres? Quand la légalité la dispute à la légitimité, le juge « suprême » peut s’ériger en garant de la stabilité sociale et de la paix collective, buts ultimes de toute législation ou réglementation dans la société.
Eus égards à ces dispositions affichées dans le préambule (donc partie intégrante de la Constitution), tout empêchement par l’autorité administrative opposée à des partis ou coalitions à changer dans les délais raisonnables précédant la période contentieuse (saisine du juge constitutionnel) et résultant d’une interprétation restrictive de la loi, serait attentatoire aux garanties constitutionnelles évoquées supra. En reprenant les arguments enchâssés dans le dispositif constitutionnel global, cela donnerait ceci :
Considérant que refuser à un mandataire d’une coalition (majorité au pouvoir) de retirer sur sa liste un parrainage de plus ou à une coalition ( regroupant les deux forces principales de l’opposition arrivées successivement 2e et 3e aux dernières élections) de remplacer un homme par une femme pour se conformer à l’obligation légale de parité, pourrait avoir des conséquences qui menaceraient gravement la paix, sans compter le fait que leurs exclusions respectives des élections rendraient de facto illégitime toute représentation qui serait issue d’une telle élection
Considérant que rien dans la loi n’interdit de corriger dans les délais et avant l’ouverture de la période contentieuse devant le Conseil constitutionnel une erreur matérielle voire mineure survenue sur une liste et qui pourrait être source d’invalidité, étant entendu par ailleurs que ce qui n’est pas formellement interdit en droit est implicitement permis (art 5 de la Déclaration des droits de l’homme et du citoyen ratifiée par le Sénégal et comprise donc dans le Bloc de constitutionnalité), la Direction générale des élections n’avait pas donc à se déclarer incompétente pour accepter les modifications sollicitées par une coalition sur une liste afin d’en assurer la conformité avec la loi sur la parité.
Considérant qu’une interprétation restrictive de la loi électorale favorable à une liste et défavorable à une autre dans des situations factuelles quasi similaires, tant il est question d’erreurs matérielles ou mineurs parfaitement rattrapables pour assainir la compétition électorale, et qu’un raisonnement contraire violerait la disposition de la Constitution qui garantit un État moderne fonctionnant « selon le jeu loyal et équitable entre une majorité qui gouverne et une opposition démocratique, et un État qui reconnaît cette opposition comme un pilier fondamental de la démocratie et un rouage indispensable au bonfonctionnement du mécanisme démocratique » (Constitution du Sénégal)….
Mon raisonnement s’arrête ici, la décision revient au juge constitutionnel. Il faut lire mon raisonnement comme une contribution à la recherche d’une solution pacifique qui préserve l’exemplarité historique du « contrat social sénégalais ».
Ce que je sais par expérience, c’est que dans les grandes démocraties, surtout celles de l’Amérique du Nord, il est arrivé souvent que le juge « suprême » s’érige en juge d’opportunité, raisonne au-delà du droit en pensant à la préservation de l’équilibre sociétal. C’est une mission historique et sacerdotale que s’auto-attribuent parfois les juges placés au sommet de la pyramide judiciaire, ce qui fait d’ailleurs dire à la doctrine que ces derniers « sont capables de réécrire le droit ».
Le Conseil constitutionnel sénégalais fait face à l’histoire!
Quant aux acteurs politiques, je dirais que vouloir s’arcbouter sur l’invalidation administrative d’une liste opposée pour gagner est assimilable à la situation d’un lutteur qui compte sur la blessure et donc sur le forfait de son adversaire pour pouvoir triompher sur tapis vert ou décision arbitrale. Au-delà de l’absence de légitimité qui en résulterait, où est le courage? À vaincre sans péril, on triomphe sans gloire!

Mais le plus choquant pour un Pr comme vous c’est que vous comparez malhonnêtement le problème de YAW à la liste de BBY en sachant très bien que cette liste n’a aucun problème, respecte la loi et sera validée par le CC. En réalité, vous manipulez les gens comme d’habitude et vous appelez en sourdine à la violence , comme l’a fait votre agenda caché Sonko Sodomiseur ! Mais malgré son appel insistant à une « grande manifestation », la réponse de Dakarois au tribunal hier a été formelle : zéro manifestation, zéro problème ! Les sénégalais ne sont pas dupes et personne ne sacrifiera encore de jeunes naïfs dans la rue alors que vous protégez vos propres enfants chez vous à la maison ! La liste de YAW sera rejetée avec raison et la liste de BBY sera acceptée avec raison par le CC té dara dou khéw si miim réw ! Lifi amoon dotoufi amaat….
